1. Services Overview
WIT Networks provides SMS and MMS messaging services via WIT Networks using approved carrier channels including 10DLC (10-digit long code) and toll-free numbers. These services are intended for Application-to-Person (A2P) communication only and may not be used for Person-to-Person (P2P) messaging unless explicitly approved.
2. Regulatory Compliance
Customer agrees to comply with all applicable laws, CTIA Messaging Principles and Best Practices, and carrier-specific rules regarding messaging content and delivery.
2.1 The Campaign Registry (TCR)
Customers must register Brands and Campaigns through TCR, with WIT Networks acting as the Campaign Service Provider (CSP). All messaging traffic must be tied to an approved TCR campaign.
2.2 Consent Requirements
You must obtain express consent from recipients before sending messages. Opt-in and opt-out mechanisms must be clearly disclosed, supported, and honored.
3. Messaging Content Restrictions
You may not use our Services to send:
- Unsolicited or spam messages
- Misleading, fraudulent, or deceptive content
- Content related to illegal activities, hate speech, or adult material
- Affiliate marketing, unless pre-approved and clearly disclosed
- Links using public URL shorteners (e.g., bit.ly, tinyurl)
WIT Networks reserves the right to block or suspend messaging that violates these terms or carrier requirements.
4. Message Throughput and Delivery
Messaging throughput is determined by carrier-defined limits based on your campaign type and Brand vetting status. WIT Networks and its upstream providers do not guarantee message delivery or timing.
5. Suspension or Termination
We reserve the right to suspend or terminate your access to messaging services at any time, with or without notice, for:
- Failure to comply with these Terms
- Regulatory non-compliance
- Carrier or connectivity partner requirements
- Evidence of abuse, spam, or fraud
6. Fees and Billing
Monthly messaging campaign fees are billed in accordance with current TCR rates and any applicable usage-based charges. A minimum 3-month commitment is required for most campaigns, excluding Political use cases.
You are responsible for all charges incurred under your account.
7. Acceptable Use and Security
You agree to implement commercially reasonable safeguards to prevent unauthorized use of the Services. This includes access controls, spam filtering, and monitoring of account activity.
8. Data Privacy
We collect and process limited personal data as required to provision messaging services. All data handling complies with our Privacy Policy, and applicable data protection laws.
9. Support and Maintenance
Support is available via email or phone. Scheduled maintenance or service interruptions will be communicated in advance where possible.
10. Limitation of Liability
WIT Networks is not liable for indirect, incidental, or consequential damages arising from the use or inability to use the Services, including delays, message failures, or regulatory fines resulting from customer misuse.
11. Modifications
We may update these Terms from time to time. Continued use of the Services after changes constitutes your acceptance of the updated Terms.
